Paying less, legally
Company pension (betriebliche Altersversorgung)
Contributions to a pension fund, Pensionskasse or Direktversicherung are tax-free up to 8% of the general pension contribution ceiling, which is €101,400 for 2026, so about €8,112 a year.
Retirement contributions as special expenses
Basic pension payments, including Rürup contracts, are deductible up to the top contribution to the miners' scheme. Employees see the ceiling cut by their statutory contributions and the employer share, and joint filers double it. The 2026 ceiling for that scheme is €124,800 of earnings.
Savers' allowance
The first €1,000 of capital income per person, €2,000 for spouses assessed jointly, is untaxed. It replaces any deduction of actual expenses.
Commuting allowance
Each working day brings €0.38 per full kilometre between home and the first workplace. A general ceiling of €4,500 a year applies, and it can be exceeded by those commuting in their own or a provided car.
Childcare costs
80% of childcare spending is deductible, up to €4,800 per child under 14. An invoice and a bank payment are required.
Who is tax resident in Germany?
Section 1 of the Income Tax Act catches anyone with a Wohnsitz or habitual abode in Germany, on worldwide income. A Wohnsitz means holding a dwelling in circumstances suggesting it will be kept and used. A continuous stay of more than six months creates habitual abode from its first day, with private stays of up to a year excepted.
The trap to know
Leaving triggers a deemed sale. Section 6 of the Foreign Tax Act taxes holdings of at least 1% in a company once a person who has been resident for seven of the last twelve years gives up residence. Payment can be spread over seven annual instalments, free of interest but generally against security, and the claim lapses on return within seven years if conditions are met.
