Special regimes

Temporary resident exemption Open

Exempt from Australian tax on foreign-source income; capital gains tax applies only to taxable Australian property

Who : Holders of a temporary visa who are not social security residents and have no Australian spouse. Limit : Lasts while the status lasts; ends on permanent residency. Source

Who is tax resident in Australia?

Four statutory tests apply, led by the resides test, which looks at how a person actually lives. The domicile test catches people with an Australian domicile unless their permanent place of abode is abroad. Being in Australia for more than half the income year also makes someone resident, unless their usual place of abode is outside the country and they do not intend to settle.

The trap to know

Becoming a non-resident triggers CGT event I1: the ATO treats non-property assets as sold on departure unless the individual chooses to disregard those gains and losses, which keeps the assets in the Australian net until later. Division 296 also needs watching by anyone with a large super balance.
